Though you technically own the rights to your design from the moment of its inception or creation, the most important thing you can do to protect it is to have it copyrighted. Once your design is copyrighted, you officially own the design and have exclusive rights to reproduce, distribute, or publicly display the design (unless the design was created “for hire,” meaning you made the design for an employer).

Once you register your design with the U.S. Copyright Office, it will deter individuals from stealing your design, or, if they decide to steal it anyway, it will be easier to pursue damages from them.

Pursuing Damages

Whether your design was copyrighted or not, if we can prove that it was stolen, you should qualify for damages. If your design was copyrighted, we can pursue statutory damages, which can range from $750 to $30,000, and in some cases, even more. If your design was not copyrighted, we may still seek actual damages on your behalf.
