Copyright Lawyers | Helping Creative Professionals in New York State
Many people who realize their work has been stolen will simply try and pursue damages on their own. Unfortunately, this isn’t always easy, as sometimes, intellectual property thieves are difficult to track down, and sometimes, people will even steal intellectual property anonymously, making them nearly impossible to find. Fortunately, the New York copyright lawyers here at CopyCat Legal have extensive experience handling all facets of copyright infringement cases, and we are here to put that experience to work for you in your case. We protect the following works:
How Do I Copyright My Work & Do I Need to Renew it?
The first thing you should understand is that technically speaking, your work is copyrighted from the moment you create it. That said, it’s always best to go through the process of formally copyrighting your work, which is, fortunately, relatively simple. In fact, you can do it online on the U.S. Copyright Office’s website by simply submitting a completed application form and a copy (or copies) of work to be registered. You will also have to pay a small fee. Once you do, as long as the Office verifies that your work is, indeed, original, you should receive a formal copyright.
Many people wonder if they’ll need to renew their copyrighted work at some point, as they would with patents. Fortunately, you don’t. Once your work is copyrighted, it will remain copyrighted for the remainder of your life and 70 years after your passing.
How Much Compensation Can I Receive in a Copyright Infringement Lawsuit?
If your work has been stolen, our New York copyright lawyers can file a copyright infringement lawsuit on your behalf and work to receive compensation for the damages you’ve incurred as a result of the theft. As long as we can prove your case, you should receive compensation for statutory damages, as well as actual damages (in some cases).
When it comes to statutory damages, you can receive anywhere between $750 and $30,000 in damages (but in some cases, up to $150,000). That said, you may receive additional damages through “actual damages,” which are a bit more complicated to calculate, but essentially can be attained by demonstrating proof of lost revenue as a result of the copyright infringement.
